Terms of Use

These Terms govern your use of treeshy.com, an online service for designing family trees, downloading them as print-ready files and ordering printed posters. By creating an account, starting a design, buying something or otherwise using Treeshy, you agree to them. Treeshy is operated by [TODO: confirm legal name and address of the operator]. 1. Accounts

You can create an account with your email address, which you confirm with a link or a one-time code we email you, or by signing in with Google. You must keep your credentials secure, give us an email address you can receive mail at, and use the service only lawfully. You are responsible for activity performed through your account. You must be at least [TODO: confirm minimum age, e.g. 16 or 18] years old to create an account or buy anything.

2. Free previews and free pictures

When you fill in one of our online design forms, we make a free preview of your design, including an AI-generated artwork, before you pay anything. A preview is locked until it is paid for. If it is not bought or unlocked within 3 months of being made, we delete it. One free preview can be open per email address at a time.

Where the form offers it, you can download a free screen-size picture of your preview. It carries a treeshy.com watermark, is meant for sharing with family and friends, and is not intended for printing. You may not remove or hide the watermark.

3. Subscriptions

Treeshy offers an Individual subscription and a Professional subscription, each billed either monthly or yearly. A subscription unlocks the online editor, where you can change the template, layout, fonts and design, add and edit people, names, dates and photos, import a GEDCOM file, and save your projects in your account with cloud autosave. Plans differ in their limits:

• Individual: up to 10 projects, 1 GB of online storage, and 1,000 AI credits each month (12,000 at once each year on yearly billing).
• Professional: no practical project limit (currently up to 1,000 projects), 10 GB of online storage, and 3,000 AI credits each month (36,000 at once each year on yearly billing).

A subscription also includes up to 5 print-ready PDF exports per project; to make another, you delete an existing export first. Printed posters are not included and are sold separately.

The price, currency and billing interval are shown before you pay. Payments are processed by Stripe. [TODO: confirm how sales tax/VAT is handled and whether shown prices include it.] Your subscription renews automatically at the end of each billing period, and you are charged the then-current price for your plan, until you cancel. If we change the price of your plan, we will tell you before the new price applies to your next renewal [TODO: confirm notice period]. From time to time we may offer promotion codes or discounts; each applies only as described in the offer, and only one may be used per checkout.

You can cancel at any time through the billing portal in your account. Cancellation takes effect at the end of the paid billing period, and paid features remain available until that date. After that, your account no longer has an active subscription. If at least one billing period was paid and that payment was not refunded or disputed, the projects you made while subscribed stay yours: you can still see them, download and export them, order printed posters of them, and delete them. You cannot open, edit, rename or create projects, generate AI artwork or upload images until you subscribe again. If a renewal payment fails, paid features may stop until the payment succeeds.

Unless required by law, subscription fees already charged are non-refundable, including for unused time, unused AI credits or unused storage. [TODO: confirm how the statutory 14-day right of withdrawal is handled for subscriptions and AI credit packs bought by consumers in the EU/UK; checkout does not currently ask for a waiver for these purchases.]

4. AI credits and AI-generated artwork

AI credits are used to generate artwork for your designs. The number of credits a generation costs is shown before you start it and can change when we change the AI model we use. A paid plan credits its allowance at the start of each paid billing period. Unused credits stay on your balance, but they can only be spent while you have an active plan, from a subscription or from an Etsy order (section 6). If a generation fails or is cancelled, the credits it used are returned to your balance. If you already have a subscription, unlocking a free preview also uses credits from your plan, as shown on the button.

Accounts on the Individual plan, from a subscription or from an Etsy order, can buy an extra pack of 1,000 AI credits for a one-time payment, processed by Stripe; an active plan is required to buy and to use them. AI credits have no cash value, are not transferable, cannot be exchanged for money, and are lost when you delete your account.

Artwork is generated by third-party AI models from the choices, description and reference images you provide. Results can be unexpected, imperfect or similar to artwork made for other people, and we do not guarantee that a result is unique or suitable for any particular purpose. Do not ask for artwork that copies someone else's protected work, trademarks or the likeness of a real person without the right to do so. Subject to these Terms and to the rights of others, you may use the artwork in your designs for your own personal purposes and, on a Professional subscription, for your work with your own clients. 5. One-time design file purchase

Where our online form offers it, you can instead buy the file of one design made with that form for a single payment in US dollars, processed by Stripe. A promotion code can be entered on the payment page when one has been given to you. A one-time purchase is not a subscription and is never charged again.

It includes only a print-ready PDF of that design exactly as previewed, without the preview watermark. Before paying you choose a print size from those your design prints sharply at; if your artwork is too small for every standard size, the PDF keeps the design's own page size. The name frames stay empty, as in the preview, to be filled in by hand. It does not include editing, names, photos, online storage, AI credits, or any other subscription feature. If you already have an active plan, from a subscription or from an Etsy order, you do not need to buy the file and the option is not offered.

The file is digital content that we start preparing right after payment. At checkout, you ask for this immediate delivery and confirm that you then lose your 14-day right of withdrawal.

6. Etsy orders

If you bought a Treeshy design on Etsy, we send you a personal link that replaces payment on our site. The link opens one design form, allows the number of designs included in your Etsy order, and works for 30 days from when you first open it. You still confirm your email address with a code. The first account that starts a design with the link becomes its only user, so do not share it. While the link is valid, that account has the Individual plan, at no charge and without renewal; no payment details are asked. It is the same plan as an Individual subscription, with the same features and limits: up to 10 projects, 1 GB of online storage and 1,000 AI credits, and the designs made with the link count toward those limits like any other project. Only the way it starts and ends differs. After the 30 days, the designs and projects you made stay yours on the same terms as after a subscription ends (section 3): you can still see them, download and export them, order printed posters of them, and delete them. If the link is revoked, for example because the Etsy order was refunded, the access ends at once, and so does keeping the projects through that order. Payment, cancellations and refunds of the Etsy order itself are handled through Etsy under Etsy's terms.

7. Projects and availability

An active plan, from a subscription or from an Etsy order, is required to create, open, rename, edit, or save a project, within the limits of your plan. Exporting a project requires an active plan or a purchased design file for that project. If you have paid for at least one subscription period, or bought a Treeshy design on Etsy, you can also export your projects after your plan ends, within the same limit of exports per project. Account holders without an active plan may view project metadata and delete projects. Editor snapshots are saved to our database using a last-write-wins model; simultaneous changes from different tabs or devices are not merged, and the final save replaces the earlier snapshot.

8. Exports and downloads

Exports are print-ready PDF files delivered in a ZIP file. A purchased design file is delivered the same way: you can download it right after payment and again later from your order page, as long as the purchase is not refunded and its payment is not disputed. Each generated file and its shareable download link remain available for up to 24 hours; after that you can make a new one where your purchase or plan allows it. Anyone with a valid link can download the export until it expires, so you are responsible for deciding who receives it.

9. Printed posters

You can order a printed poster of a design with a purchased file, of any design while you have an active plan, from a subscription or from an Etsy order, and of your projects after that plan ends if you have paid for at least one subscription period or bought a Treeshy design on Etsy. A poster is offered as a print on matte art paper or as a print in a classic frame. Our print partner, Prodigi, prints and ships it for us. The poster shows the design as it was when you started checkout; changes you make later are not printed. In a frame, the frame covers a thin strip at each edge of the print, and frame colors may vary slightly from the preview. A poster bought straight from a free preview also includes that design's file.

The price shown before payment includes shipping. Payment is processed by Stripe in US dollars. We deliver only to addresses in the United States, using Prodigi's Standard shipping, free of charge. We do not guarantee a delivery date.

Each poster is personalised and made to order for you, so it cannot be returned or exchanged. To cancel an order, contact us through the contact form as soon as you can. If the order is cancelled before production starts, you get a full refund. Once production has started, we may no longer be able to cancel it.

If a poster arrives damaged or misprinted, send us a photo of it through the contact form within 30 days of delivery. We raise the claim with Prodigi and send you a free reprint or a refund. Please check your shipping address at checkout: if a poster cannot be delivered because of a mistake in the address you entered, we can send it again, and you pay what that costs us.

Nothing in this section limits rights you have under consumer protection law.

10. Your content and family information

You keep ownership of the names, dates, family details, GEDCOM files, photos, reference images and descriptions you add. You grant Treeshy a limited, non-exclusive permission to store, process, render, print and export that content, and to send it to the service providers named in our Privacy Policy, only as needed to provide the service you request. This permission ends when you delete the content or your account, except for copies kept as described in the Privacy Policy, such as print orders.

Family trees often contain information about other people, including living relatives and children. You are responsible for having the right to add it, including any consent required for photos or details of other people, and for respecting their privacy when you share designs or download links.

Treeshy templates, artwork styles, branding, and interface elements remain our property and may not be copied or redistributed except as allowed by the service.

11. Prohibited use

• Do not upload unlawful content or content you have no right to process.
• Do not use the service, including AI generation, to create content that is hateful, harassing, sexually explicit, or that infringes the rights of others.
• Do not bypass subscription, AI credit, authorization, download, watermark, or storage restrictions, or share prepaid links or accounts with others.
• Do not introduce malicious code, scrape the service, or disrupt other users.

12. Account deletion and service changes

You may permanently delete your account from your profile. This removes your account, projects, uploaded images and exports, and your remaining AI credits. Deleting your account also cancels an active subscription immediately, without a refund for the rest of the billing period. A paid print order is kept after account deletion, and we still email you about it. Purchase and billing records are kept as described in the Privacy Policy. We may change or discontinue features, remove unlawful content, or suspend accounts that violate these Terms.

13. Disclaimer and liability

Treeshy is provided on an “as available” basis. We do not guarantee uninterrupted access or recovery of every change or expired export. To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of the service. Nothing in these Terms limits liability that cannot be limited by law or rights you have as a consumer.

14. Changes and governing law

We may update these Terms as the service changes. We will show the date of the latest update above and, for significant changes, tell account holders in advance by email or in the app. These Terms are governed by the laws of [TODO: confirm governing law and jurisdiction].
